IN ALL CASES, DEWEY'S PIZZA'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO DEWEY'S PIZZA IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).
The limitations of liability set forth in this section are fundamental elements of the basis of the bargain between Dewey's Pizza and you. Some jurisdictions do not allow the limitation of certain types of liability. To the extent such limitations are prohibited under applicable law, some of the above limitations may not apply to you.
11. Indemnification
You agree to defend, indemnify, and hold harmless Dewey's Pizza and its officers, directors, employees, agents, contractors, licensors, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your access to or use of the website or Services.
- Your violation of any provision of these Terms of Service.
- Your violation of any third-party rights, including but not limited to intellectual property rights, privacy rights, or publicity rights.
- Your violation of any applicable federal, state, or local laws or regulations.

13. Dispute Resolution and Arbitration
13.1 Informal Resolution

The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
13.3 Class Action Waiver
YOU AND DEWEY'S PIZZA EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. All disputes shall be resolved on an individual basis only. This waiver applies to all claims, whether arising in contract, tort, statute, or otherwise.
13.4 Small Claims Court
Notwithstanding the foregoing, either party may bring an individual action in small claims court in the jurisdiction of Dewey's Pizza's principal place of business, provided the claim qualifies under the applicable rules of that court and is not aggregated with other claims.
14. Term and Termination
These Terms of Service shall remain in full force and effect for as long as you access or use the Dewey's Pizza website or Services. Either party may terminate this Agreement at any time and for any reason.
Dewey's Pizza reserves the right, at its sole discretion and without prior notice or liability, to:
- Suspend or terminate your account and access to all or any portion of the Services.
- Cancel any pending or unprocessed orders associated with your account.
- Remove any User Content submitted by you.
- Take any other action deemed appropriate in response to a violation of these Terms.

20. Entire Agreement and Severability
